PLANNING BOARD MINUTES      February 25, 2002

MEMBERS PRESENT included: Chairman Doug Allen, Mert Bartels, Brian Gagne and Kevin Rooney.  Also present was Town Engineer / Zoning Officer, Scott Allen and Town Councilman, Ken Nawrocki.  Absent were members Howard Jordan, Tom Morrison and Tom Ferreri.

Chairman, Doug Allen, called the meeting to order at 7:31 p.m.

LOG INS:

Williams-Dillon / Beebe Rd / 1 Lot Site Plan
Scott Allen recommended that the members of the board drive by this site prior to the next meeting.  He explained that he has already heard of neighborhood interest in this project and that there are State and Federal Wetlands on the site.  Scott also stated that the property did perc, this was witnessed by MRB.

Waasdorp-Pecora Estate / Farmington Rd / 1 Lot Realty Subdivision
Mr. Waasdorp is purchasing part of the Pecora Estate to add to his property.

NEW BUSINESS:

Stillwater Nursery / Quaker Rd / Special Use Permit Recommendation to the Town Board
Jason Monroe of Lu Engineers was present to address the board.  He reviewed the letter submitted to the Town Board dated January 29, 2002 and explained that the applicant would like to operate a Landscaping Business at the location that was recently approved for a Nursery.  Jason explained that the business would operate in compliance with Section 135-182.  Jason stated that they were requesting designated outside storage for equipment.  Lighting, hours of operation and parking were also reviewed.  Brian questioned of the wording in the letter that currently reads "property maintenance" should actually read more specific.  The board agreed that the term property maintenance was too broad and Jason was told the wording should be changed to snow removal and sidewalk maintenance.  Brian also questioned if the applicant understood that the code currently does not allow for storage of any material in more than three cubic yards.  Jason explained that the applicant is aware of this, however, they are also under the assumption that the Town is currently reviewing this code for change.  Jason told the board that the applicant has worked out an arrangement with the supplier to pre-buy and store on their location for the time being.  The only storage on the property will be equipment, at this time.  Jason told the board that approximately 8 acres of the property would be nursery stock.  A motion was made by Brian Gagne to give a positive referral to the Town Board for this application pending the change in wording discussed; Kevin Rooney seconded, all in favor.

OLD BUSINESS:

Alpco / 846 Macedon Center Rd - Wilcox Rd / Fill Permit
No one was present to address the board from Alpco.  A motion was made by Mert Bartels to table this application, seconded by Brian Gagne, all in favor.

Marvins Gardens - Donn Calabrese / Wayneport Rd / Rezoning Recommendation to the Town Board
Rod Prossor of Lakeside Engineering was present to address the board.  He began by stating that reports were submitted to the Town Engineer concerning Wetland delineation, Sewer and Traffic.  Rod explained that the traffic report included the full build out of this application and takes into consideration the other rezoning application to the North.  Rod explained that possible improvement for the traffic would include light timing and turning lanes at the intersection of Route 31 and Wayneport Rd.  He stated that this would raise the traffic rating to a B.  He stated that the applicant would like to proceed with the rezoning at this time and they are looking for a referral to the Town Board.  Doug explained that Dean Collins, a Town Councilman, reviewed the traffic study and had concerns.  Scott continued to explain that the Town has concerns about the intersection of Wayneport Rd and Wilkinson Rd and the traffic study presented did not give enough attention to this intersection.  Rod stated that he would review this.  Scott continued to explain that other concerns were more technical in nature.  Scott gave the example of the lift station, which he stated was currently working, however, is close to full capacity.  Scott stated that the Town Board was going to take lead agent on this application and a Type 1 action for the Environmental Review process would be needed.  Scott explained that given the proximity of the two rezonings and the public interest involved, it would be in both the Towns and the Applicants best interest to do this.  This is the best support for whatever decision is made in the end.  Ken Nawrocki stated that from the Town Boards view point, the zoning code is what it is for a reason and in order to change it, the Town Board needs a significant amount of data and this would be the best way to look at the application.  Scott continued to explain that much of the start up work for this process has already been done.  Scott also stated that the other rezoning applicant is still in the process of reviewing their project and is considering removing the proposed apartments.  A motion was made by Brian Gagne to refer this application back to the Town Board for a Full Review Process and for the Town Board to assume lead agent, seconded by Kevin Rooney, all in favor.

ZBA REFERRALS:

Rock-N-Wash (Joseph DelFino) / 992 Route 31 / Area Variance - Section 135-162-B / Would like to add another bay with a 105' Setback
Scott explained that this project is located in an R-30 Zone and is a non-conforming building and a non-conforming use.  This means for approval the applicant must apply to the Zoning Board of Appeals, the Planning Board and the Town Board.  Scott explained that with this addition the building would have a 5' setback from Brixton Drive.  Kevin asked if it was possible to add to the other end of the building.  Scott explained that he made several different suggestions to the applicant and this is the only way it will work for him.  Scott explained that the laser wash equipment was all at this end of the building.  Scott also explained that the R-30 zoning district has no code for setbacks of a commercial building, the only setback are the 250' from Route 31.  The board unanimously stated that they could not support a 5' setback from Brixton Drive and submitted a negative referral to the Zoning Board of Appeals for this application.

Mike Young / 3051 Daansen Rd / Area Variance - Section 135-61 / Would like to have house setback behind existing barn
The board gave a unanimous positive referral to the Zoning Board of Appeals on this application given that the barn is not seen from the road and the distance this house will sit from the road.

 Macedon Hills Restaurant / 1090 Route 31 / Area Variance -  Section 135-162-B / Addition of a smoking room within the 250' setback
Scott explained that this was an expansion of a currently non-conforming building.  This is an allowed use in the GC district.  Scott also explained that with this addition the building will still meet all other setbacks and would still have adequate parking.  Scott explained that the owner has seen a drop off in business since the new smoking law has been in effect.  A unanimous positive referral was given for this application to the ZBA.

Richard Deys / 1472 Macedon Center Rd / Area Variance - Section 135-61-B-3 / Request to Build a Barn Larger than the existing residence
Scott explained that this was an application for a 5000 SF barn, 50'x100'.  The applicant's property is over 20 acres and the barn will sit a ways off the road.  Scott explained that the applicant has several recreation vehicles and other equipment and this would be for inside storage of those things.  A unanimous positive referral was given to the ZBA considering that inside storage is better than outside storage and the size of the property.

OTHER PERTINENT BUSINESS:

Scott told the board about training being offered by the Wayne County Planning Department.  Each board member received a copy of the notice; the classes are free if anyone is interested.

Carl Eligh was present to address the board concerning Gananda Partnership and the demolition of the barn on Hance Rd.  Carl stated that on Friday when they buried the barn they also buried all the other items that were on the property.  Carl stated that there were old combines, steel rods, aluminum and window frames.  Scott stated that during the PRC meeting it was discussed that they would bring in roll-off to remove such items.  Carl stated that this was another example of this applicant telling the board one thing then doing another.  The Planning Board has no jurisdiction over this; Scott will look into this.  Carl also stated that he contact DEC and the Army Corp of Engineers concerning this project on Hance Rd and was told that the applicant did not have a complete application into them at this time.  He stated that he was sending a letter to DEC and the Army Corp of Engineers with the concerns of the neighborhood for this application.
